Your BrandWire Account

When you sign up and open an account with BrandWire, you are solely responsible for your account security and for all activities that occur in or are connected to your account.

Avoid providing or describing misleading or illegal keywords for your press release content. BrandWire retains the right to alter, remove, or replace keywords or descriptions deemed misleading, inappropriate, or harmful to BrandWire's reputation.

If you notice unauthorised access to or activities in your account, alert BrandWire immediately. BrandWire does not allow accounts to be used for dangerous or illegal activities. If suspicious activities are noticed, BrandWire may close the connected account and report to the relevant authorities.

BrandWire Website Visitor's Responsibilities

BrandWire cannot review all content, links, or software related to content posted on and distributed by BrandWire, and is therefore not responsible for future effects of the same.

Posting content through BrandWire does not mean BrandWire confirms the accuracy or usefulness of that content. As a website visitor or user, you are responsible for your content and for taking necessary steps to protect it from malware, spam, or viruses.

The website may contain content that is imperfect, contains grammar mistakes or typos, infringes intellectual property rights or privacy rights, or is offensive. BrandWire will not be responsible for damage or harm caused by downloading content from the website.

Accountability of Contributors to BrandWire Services

You hold full responsibility for all content and links you upload onto the BrandWire platform and are answerable for any damage or harm resulting from the content. This includes text, audio files, video files, software, graphics, or any other components included in your contribution.

  • Your content is free from Trojan horses, malware, viruses, or other elements that can harm the website.
  • Your content is spam-free and contains no spoofing, phishing, or unethical elements created to affect SEO or drive traffic to third-party sites.
  • Downloading, copying, and use of your contributed content will not infringe property rights, including trade secret rights, patents, copyright, or third-party rights.
  • You have reviewed and handled all third-party licenses and required terms.
  • You will not use misleading brand names or names that make readers believe you are a company or person you are not.
  • All content will be accurate and up to date, and you are responsible for ensuring its authenticity.
  • You will not submit or post misleading content or content containing false information.
  • If your content results in issues, you agree to defend and hold BrandWire and its directors, employees, officers, and agents harmless.

Once you submit content on BrandWire, you agree that BrandWire has the right to modify, reproduce, distribute, and publish it.

If you delete your content, BrandWire will remove your content from the website. BrandWire is not responsible for removing submitted content from other websites to which the content has been distributed.

Liability Limitations

Under no circumstances shall BrandWire and its affiliates, suppliers, or licensors be held liable for damages, losses, or claims relating to or arising out of this Agreement, whether based on negligence, contract, equity, tort, strict liability, or any other legal or equitable doctrine.

  • Any indirect, incidental, consequential, punitive, or special damages.
  • Costs associated with replacement, acquisition, or procurement of substitute goods or services.
  • Loss, corruption, or unavailability of data, including interruption of system or service use.
  • Any damages exceeding the total fees paid by the user to BrandWire within the one month period preceding the event giving rise to the claim or alleged breach.

BrandWire bears no responsibility for delays, non-performance, or service interruptions resulting from causes beyond its reasonable control, including force majeure events. These limitations apply only to the maximum extent permitted under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless BrandWire, including its officers, directors, employees, agents, licensors, contractors, affiliates, subsidiaries, and representatives, from and against any claims, liabilities, damages, losses, legal proceedings, judgments, costs, and expenses, including reasonable litigation costs, arising from or related to your use of the website or services, including any breach or violation of this Agreement.

Miscellaneous Provisions

You undertake to use the services solely for their lawful and intended purposes.

Unauthorized activities, including reverse engineering, replication, imitation, decompilation, or unauthorized incorporation of the platform's services, systems, or processes into competing or derivative services, are strictly prohibited.

You shall not lease, sublicense, sell, distribute, reproduce, modify, or copy any portion of the software or services, nor attempt to access, derive, or extract the underlying source code or proprietary technology.

Governing Law and Entire Agreement

This Agreement constitutes the complete and exclusive understanding between the parties concerning the subject matter herein and may only be amended through a written instrument executed by an authorized representative of BrandWire or through an officially updated version published by BrandWire.

BrandWire reserves the right to assign or transfer its rights and obligations under this Agreement to any successor or third party agreeing to be bound by these Terms.

This Agreement shall be governed by and interpreted in accordance with the laws of India, and you irrevocably consent to the exclusive jurisdiction and venue of the competent courts located therein.

Business Profile Responsibility

BrandWire permits the creation of business profiles in the interest of transparency. By submitting business-related information, you represent and warrant that all information provided is accurate, complete, and lawful.

You acknowledge and accept sole responsibility and liability for the content and accuracy of all submitted information.

Refund and Cancellation Policy

BrandWire reserves the right to reject, suspend, remove, or cancel any press release submission that violates its Terms and Conditions or editorial standards. Where a submission is rejected and cannot be approved after corrective measures, the user may, at BrandWire's discretion, receive promotional or distribution credit for future use in submitting another press release.

BrandWire further reserves the unrestricted right to remove or discontinue any press release associated with its distribution or content-writing services. In such instances, users may apply existing credits toward an alternative press release submission or another eligible writing topic, subject to applicable terms.

Placement or publication by third-party media outlets is not guaranteed and remains solely at the discretion of such publishers. Accordingly, no refunds shall be issued where a third-party platform declines, rejects, or refuses publication of a press release.

Once a press release has been approved and subsequently deleted by the user, no refund, reimbursement, or compensation shall be provided. Users bear sole responsibility for ensuring the accuracy, legality, and appropriateness of submitted press release content.

Where promotional placements are declined by partner websites or publishers, BrandWire may notify the user of the reason for rejection and permit unused value or credit to be applied toward alternative promotional services, where applicable.

Promotional credits are non-transferable and may not be exchanged, reassigned, or shared between separate user accounts.
